Terms of Service
These Terms govern your use of the Millpond app and services (“Millpond”, “we”, “us”), operated by Alikhan Mussabekov (an individual developer based in Kazakhstan). By using Millpond you agree to these Terms.
1. What Millpond is — and is not
Millpond is a social wellness app. It computes a daily “Calm Score” from your wearable data and lets you compare your weekly score with friends and others in your city.
Millpond is not a medical device or medical service. It does not diagnose, treat, cure, or prevent any condition, and it does not provide medical advice. The Calm Score is an informational, motivational metric — not a clinical measurement. Always consult a qualified professional for health concerns, and never disregard medical advice because of something in the app.
2. Eligibility
You must be at least 13 years old (or the minimum age in your country) to use Millpond. By using it, you represent that you meet this requirement.
3. Your account
Millpond uses Sign in with Apple. You are responsible for activity under your account. You may delete your account at any time.
4. Millpond Plus subscription
Millpond offers an optional auto-renewable subscription, Millpond Plus, which unlocks additional features (currently a 90-day calm trend and a Plus profile badge). The core app remains free.
- Plans & price: Millpond Plus is offered as a monthly or annual auto-renewable subscription. The exact price and billing period are shown on the purchase screen inside the app and may vary by region.
- Free trial: if a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Auto-renewal: your subscription renews automatically at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
- Payment: payment is charged to your Apple ID at confirmation of purchase.
- Manage or cancel: you can manage or cancel your subscription at any time in Settings › Apple ID › Subscriptions on your device; cancellation takes effect at the end of the current billing period.
- Refunds: purchases are processed by Apple, and refund requests are handled by Apple under the App Store terms.
5. Your content and public display
You choose a display name and optional avatar. Within your city and groups, other users can see your display name, avatar, and weekly Calm Score. Do not use a display name or avatar that is unlawful, infringing, offensive, or impersonates another person. We may remove content or accounts that violate these Terms.
6. Acceptable use
You agree not to:
- Submit falsified or manipulated scores, or otherwise game the leaderboard dishonestly;
- Attempt to access other users’ underlying health data (which we do not hold);
- Reverse engineer, disrupt, or overload the service;
- Use Millpond for any unlawful purpose.
7. Privacy
Your use of Millpond is also governed by our Privacy Policy. In short: your raw health data stays on your device; only your derived Calm Score, display name, avatar, and city leave it, to power the leaderboard.
8. Intellectual property
Millpond, its name, design, and the scoring methodology are owned by us. These Terms do not grant you any rights to our trademarks or branding.
9. Disclaimers
Millpond is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the Calm Score is accurate, that the service will be uninterrupted, or that it is fit for any particular purpose. Scores depend on data from third-party devices and platforms (e.g. Apple Health, Apple Watch, Garmin, Oura) that we do not control.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or any health-related decisions made in reliance on the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (which may be zero).
11. Termination
You may stop using Millpond and delete your account at any time. We may suspend or terminate access for violations of these Terms.
12. Changes
We may update these Terms; we will revise the “Last updated” date and, for material changes, notify you in-app. Continued use after changes means you accept them.
